Terms of Service

These Terms form a binding agreement between you and Felbastore Limited. They incorporate the Privacy Policy, the Cookie Policy, the Acceptable Use Policy and, where you list products, the Vendor Agreement.

1. Account & age

You must be at least 18 to create an account or place an order. You are responsible for the security of your credentials. We may verify identity, address or business registration as part of fraud-prevention or KYC controls.

2. Marketplace intermediary status

FelbaStore is a technology marketplace. Unless a listing is marked “Sold by FelbaStore”, the goods or services are sold by independent vendors and the contract of sale is formed directly between you and the vendor. Your statutory rights under the Consumer Protection Act, 2012 are unaffected.

3. Pricing, tax and payment

Prices include VAT where applicable. The vendor is the seller of record for tax purposes. Payments are processed by our licensed partners (Stripe, Safaricom M-Pesa, partner banks); we never store card details.

4. Wallet, credits and rewards

Wallet balances and promotional credits are governed by the Wallet & Payouts Terms. They have no cash redemption value except as expressly provided and may be cancelled where we reasonably suspect fraud or abuse.

5. Orders, delivery, cancellation & returns

Submission of an order is an offer to purchase from the vendor. The vendor is responsible for fulfilment. Returns and refunds are governed by the Refund & Returns Policy.

6. Acceptable use

You will not use the Service for unlawful purposes, abuse promotions, manipulate reviews, scrape data or interfere with the platform. The full list is in the Acceptable Use Policy.

7. Intellectual property

Platform-owned trademarks, software and design assets remain ours. You retain rights in your own content but grant us a non-exclusive licence to host and display it for the purpose of operating the Service. IP infringement claims follow the DMCA / IP Complaint Policy; repeat infringers are terminated.

8. Suspension & termination

We may, with or without notice, restrict, suspend or terminate your account, hold or reverse a payout, freeze wallet balances, or remove listings where we reasonably believe you have breached these Terms or the law, or to protect users and the platform.

9. Disclaimers and limits of liability

The Service is provided “as is” to the maximum extent permitted by law. Our aggregate liability in any twelve-month period is capped at the greater of KES 50,000 or the total fees retained by us from your transactions in that period. Nothing limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

10. Governing law and disputes

These Terms are governed by Kenyan law. Disputes are first negotiated in good faith for 30 days, then referred to arbitration in Nairobi under the rules of the Chartered Institute of Arbitrators (Kenya Branch), without prejudice to either party’s right to seek urgent injunctive relief from a competent court.

11. Changes

Material changes are notified at least 7 days in advance and tracked in our document-version registry. Continued use after the effective date constitutes acceptance.

12. Electronic acceptance & consent log

Each acceptance is recorded immutably with the document version, timestamp, IP and user-agent for evidentiary purposes.
